Nikki Haley, Governor of South Carolina signed S431, the "Crossmann Bill", which is legislation written to seek the reversal of the recent unanimous South Carolina Supreme Court decision in Crossmann Communities, Inc. vs. Harleysville Mutual Insurance Company. This act amends the code of laws of South Carolina, 1976, by adding Section 38-61-70 so as to define a "COMMERCIAL GENERAL LIABILITY INSURANCE POLICY", "CONSTRUCTION PROFESSIONAL", and "CONSTRUCTION RELATED WORK", to provide that a commercial general liability insurance policy must define or be deemed to define the word "OCCURRENCE" in a specific manner, and to provide for the scope and limits of applicability of this section. South Carolina's Chief Justice Jean Toal wrote an order that puts all pending foreclosures across the state on hold until the parties involved can complete an intervention process. In her order, Toal said that no foreclosure hearings or sales may be held until an attorney for the lender has completed a list of duties, including ensuring that the homeowner has ample opportunity to try to modify the loan to agreeable terms.
